SmartForms Privacy Notice

1. Introduction

SmartForms is a product of Duxni Tech LLC, headquartered in Tampa, Florida, USA.

This Privacy Notice describes the information Duxni Tech processes in connection with the SmartForms website, the SmartForms platform, the customer relationship, onboarding, support and platform operations.

2. Important distinction: SmartForms Customer Forms

When an individual completes a SmartForm created for a SmartForms Customer, that Customer determines the business purpose of the form and generally determines what information is requested.

The Customer's own Privacy Notice should govern the Customer's collection and use of that submission data.

SmartForms provides the technology used to process the form.

3. Information Duxni Tech may collect

• business contact information;
• account and onboarding information;
• support communications;
• billing and transaction information where applicable;
• platform configuration;
• device, browser and technical metadata;
• operational logs;
• usage metrics;
• security and audit metadata;
• website analytics and cookie data where enabled.

4. Customer submission data

SmartForms is designed by default not to permanently store Customer submission data. It is designed as a processing platform, not as the Customer's permanent repository for submitted business data.

Submission data may be processed transiently only as necessary to validate, generate, deliver or make the configured output available. When an external Customer-authorized destination is configured, SmartForms processes the submission as necessary and delivers the configured output to that destination.

For download-only configurations, the submission may be processed transiently to generate and provide the output without establishing SmartForms as the Customer's permanent record repository.

5. How information is used

• billing;
• security;
• troubleshooting;
• platform improvement;
• enforce our terms;
• satisfy legal obligations.

6. Sharing

Duxni Tech may use service providers and subprocessors necessary to operate SmartForms, and may disclose information where required by law or necessary to protect rights, safety or security.

Duxni Tech does not sell Customer personal data to advertisers.

7. Customer-controlled information

Customer administrators determine their form content, purposes, privacy links, terms and configured destinations.

8. Security

Duxni Tech applies technical and organizational measures intended to protect information processed through SmartForms. Additional information is available in the SmartForms Security & Trust page. No platform or method of transmission can be guaranteed to be absolutely secure.

9. Retention

Retention varies by category of information.

Platform configuration and account records may be retained as necessary to operate the service and meet legal and business requirements.

Transient submission content follows the configured processing and lifecycle rules.

10. International processing

Information may be processed in locations where Duxni Tech or its service providers operate, subject to applicable agreements and applicable law.

11. Privacy rights

Applicable privacy rights may vary by jurisdiction.

Requests concerning data collected through a Customer form should generally be directed to that Customer.

Requests concerning Duxni Tech account or website information may be sent to privacy@duxni.com.

12. Children

SmartForms is a business platform and is not directed to children, unless a Customer has a lawful, specifically configured use case.

13. Changes

Duxni Tech may update this Privacy Notice. Updates are reflected by an updated “Last Updated” date and, when appropriate, additional notice.
